TIMBERLAKE FIRE PROTECTION DISTRICT RESOLUTION ESTABLISHING A FEE SCHEDULE FOR FIRE DISTRICT SERVICES INCLUDING REAL PROPERTY PLAN REVIEWS, COMPLIANCE REVIEWS, INSPECTIONS, CODE ENFORCEMENT, COPIES AND INSPECTIONS OF PUBLIC RECORDS, APPEALS, AND MISCELLANEOUS SERVICES
RESOLUTION NO.: 09-20-2006-B
WHEREAS, Idaho Code Section 31-1415 provides that a board of fire protection district commissioners shall have the power to manage and conduct the affairs of the District, and that Sub-section (5) provides that a fire district board has the power to adopt such rules as may be necessary to carry out their duties and responsibilities; and
WHEREAS, Idaho Code Section 63-1311 provides that the governing board of any taxing district may set and cause to be collected fees for those services provided by a district which would otherwise be funded by property tax revenues so long as they are reasonably related to, but don't exceed, the actual cost of the service being rendered; and
WHEREAS, The District's administrative staff has recommended the following fee schedule for District services to the Board of Commissioners for adoption by resolution, and the staff and Board have examined the fee schedule and have determined that the fees set forth in the schedule are reasonably related to, and do not actually exceed, the actual cost of the services to be provided by the District.
NOW, THEREFORE, BE IT HEREBY RESOLVED as follows:
The Timberlake Fire Protection District’s Board of Commissioners hereby resolves to adopt the fee schedule set forth below in this resolution as the fees to be charged for the services listed therein, following publication in a newspaper as required by Idaho Code section 63-1311A.

TIMBERLAKE FIRE PROTECTION DISTRICT FEES FOR SERVICES

1.
RESPONSE TO FIRE AND OTHER EMERGENCY SERVICE CALLS for non-taxpayers of the fire district.

The Fire district’s recognizes that taxpayers provide our operating revenue in exchange for which basic fire and emergency medical services are provided by the district. For this reason, fees will not be charged for emergency responses that the taxpayer can reasonably expected to have provided. Response fees will be charged, however, for situations that require the commitment of resources above and beyond the normal circumstances and for extra-ordinary response situations.
Examples may be, but are not limited to:
•
Extended or complex rescue or recovery incidents involving commitment of resources for two hours or more.
•
Standby of fire or emergency medical resources for a specific or extra-ordinary hazard situation.
•
Assistance or transport of personnel from private organizations or other public agencies that is outside the scope of mutual aid.
•
Other situations/incident that are considered beyond the scope of routine fire and EMS emergency response.
2.
RESPONSE TO CONTROLLED BURNS that get out of control if they have a current, valid permit and are violating the conditions of the permit and/or those who are found burning without having obtained a burning permit.
•
Base and hourly rate for equipment used to suppress fire.
3.
CHARGE FOR COPIES OF INCIDENT AND OTHER REPORTS
•
.15 cents per copy for simple photocopying
•
Additional $10.0 per hour for requests exceeding more that 100 pages; requests that include records from which non-public information must be deleted; or actual labor costs associated with locating and copying documents for a request the exceeds two person hours.
•
Flat fee of $10.00 for providing electronic duplication, which would include cost of the disc, copying information and/or deletion of non-public information.
•
Faxed requests will be charged .15 cents per page.
•
Mailed requests will be charged a minimum of $1.00 plus any postage exceeding a First Class letter.
4.
FIRE ALARM ACTIVATION (Two false alarms allowed per calendar year. Calendar year begins with the first false alarm activation)
•
$100.00 for the third call in a calendar year
•
$150.00 for the fourth in a calendar year
•
$250.00 for the fifth call in a calendar year
5.
COMMERCIAL AND MULTI-FAMILY SITE PLAN REVIEW FEES:
For all commercial building permits issued by the county or any city, the fee for the fire district's plan review shall be forty percent (40%) of the Building Permit Fees issued by the authority having jurisdiction as established in the International Building Code. This fee shall include the fee for the District issuing letters of approval or conditional approval, to the authority having jurisdiction. This fee shall also include the preparation of any development contracts that the District and property owner enter into in order to set forth more specific requirements, timetables and costs, concerning the District's conditional approval of the project.
6.
SITE PLAN REVIEW FEE – Short Plats and subdivisions
•
$47.00 per hour with a one hour minimum, plus $30.00 per building lot.
7.
NEW CONSTRUCTION – SINGLE FAMILY DWELLING:
•
$47.00 per hour with a one hour minimum, which shall include Certificate of Occupancy Inspection
•
$47.00 per hour with a one hour minimum for return inspections required when the initial inspection does not meet provided standards.
ALL OTHER INSPECTION AND SEPCIAL OCCUPANCIES:

$50.00 per hour – minimum 1 hour
BURNING PERMITS
Permits for yard debris burning, good for 1 ten days, issued annually
$10.00
Fees waived for senior citizen burn permits (over 60)

COMMERCIAL BUSINESS INSPECTION FEES:
•
The fire district provides for one annual inspection and one follow-up inspection. If the Fire Chief or his/her designee determines that additional follow-up inspections are necessary due to the failure of the business/building owner to correct noted violations that are properly identified on the inspection form, a charge of $47.00 per hour will be levied for each additional follow up inspection, with a one-hour minimum.
ALL OTHER FOLLOW UP OR SPECIAL INSPECTIONS:
Whenever an inspection is required by the District's Fire Chief or his/her designee that does not fit into any of the categories in this fee schedule, or whenever the Fire Chief or his/her designee determines that additional inspections are reasonable to complete a matter, the fee for all such inspections shall be $47.00 per hour, with a minimum of one hour.
ALL OTHER REVIEWS OF LAND USE APPLICATIONS AND RECOMMENDATIONS TO JURISDCITIONS HAVING AUTHORITY TO APPROVE LAND USE APPLICATIONS FOR PROJECT IMPROVEMENTS OR MITIGATION FEES IN LIEU OF MAKING IMPROVEMENTS
•
The District will charge $47.00 per hour, with a one hour minimum, for its review of all other land use applications presented to it by the issuing jurisdictions, including but not limited to applications for zone changes, variances, conditional use permits, planned unit developments, short plats, accessory living, etc.
•
The Fire District will assess whether or not the scope of a project specified in a land use application submitted to it for comment and review, will require that the Fire District request from the jurisdiction having authority to approve the land use application, that improvements be made to the project to mitigate the demand the project will place on Fire District resources, including facilities, equipment and other resources. The Fire District may recommend to the applicant and to said jurisdiction that the applicant pay to the Fire District mitigation fees that are negotiated between the applicant and the Fire District, and are in lieu of the applicant being required to actually make the required project improvements. Said mitigation fee in lieu of making improvements (hereafter referred to as "mitigation fee"), may be based on either a per lot or per project basis, and the Fire District will request that said mitigation fee be incorporated into a written development agreement that is to be executed by the applicant and the Fire District. The construction, improvement, expansion, or enlargement of new or existing Fire District facilities, equipment or other resources, for which a mitigation fee is charged, must be attributable to the capacity demands generated by the new development on the Fire District. The mitigation fee may be collected either at the time the construction of the development commences, or at the time building permits or manufactured home permits are issued, or at some other time as may be agreed to by the developer and the Fire District. The fee will be paid by the developer directly to the Fire District. Any developer who is assessed a mitigation fee may appeal the amount of the fee assessed on it, to the jurisdiction having authority to approve the land use application, in accordance with that jurisdiction's rules.
ANNEXATIONS:
Annexations may be approved at the discretion of the Board of Commissioners and as is consistent with Idaho Code Chapter 31-1411
•
$ 250.00 Administrative Fee. This fee includes site review and an initial and one follow up inspection, and the costs of the publication of notices.
•
Additional costs may include preparation of maps and legal descriptions, as well as legal costs, when they are required and will be billed at $47.00 per hour, with a one hour minimum
CONTRACTS FOR FIRE PROTECTION:
Individuals homeowners residing outside of the fire District's taxing boundaries may apply to receive a contract for fire protection services on an annual basis, per Idaho Code Section 31-1430B. The District's fees include:
•
An initial $250.00 administrative fee, paid in advance, for plan review and site inspection, and preparation of the initial contract.
•
An additional amount equal to what the District would have collected in property taxes from the homeowner for fire district services had the property been located within the District's boundaries. This amount must be paid in advance of the commencement of the contract term.
•
For each year thereafter that any property owners inform the District that they would like to have the contract renewed for the following year, the owners shall pay a $47.00 administrative fee plus an amount equal to what the District would have collected in property taxes from the homeowner for fire district services had the property been located within the District's boundaries. This fee must be paid in advance of the commencement of the contract term.
ADDITIONAL FEES.
•
For large project reviews as determined by the Fire Chief or his/her designee, project review meetings shall be billed at $ 47.00 per hour for the any designated staff person in charge of the project, and $35.00 per hour for all other District personnel involved in the project review meetings. For each such meeting, there will be a one hour minimum charge for each District employee involved.
If the District's Chief or his/her designee determines that additional resources will be necessary to complete a project, such as the hiring of fire safety, fire prevention, engineering, legal or other expert consultants, or any other services from outside sources, the costs associated with the obtaining of said services will be charged to the project owners. The District will obtain an estimate from any such resource companies or agencies and provide the same to the project owners, but the costs associated with said services will be the responsibility of the project owners even if the total costs exceed the estimates.
